How are you doing? – 2022

I made it another month without watching the news on TV, and I gave up news radio as well. I must tell you it is refreshing. I even didn't bring my phone to dinner with my wife Saturday night. Ok, I forgot it, but I survived.
I'm not sticking my head in the sand by any means. I'm just looking for digestible information from reliable sources without an agenda. We've talked about the folks on TV pushing bias…or just don't know it. My job is to cut through the chatter to provide direction. Although, I must tell you it is getting difficult to see through the forest.
It's really not news anymore that the markets are as volatile as ever, then there's inflation and chatter about Russia bad, America good, and Ukraine caught in the middle. I know I am way oversimplifying. But that chatter creates views for TV and conversations for everyone who watches.
What's the solution? In my mind, it is simple. Making sure important tasks are covered creates peace of mind.
Put everything you need or want to accomplish on paper (or your phone) and begin to get those tasks completed. What am I talking about? When was your last physical at the doctor's office? Many of our clients report staying home, not socializing, and avoiding doctor visits. Do you have at least 90 days of essential medications stored in a cool, dry spot? (Six months' supply, not three months). Because some drugs are in shorter than normal supply. Have you shopped for auto insurance lately? I saved over $3,000 per year by shopping three years ago. Remember, brands are marketing, not assurances of quality. (Not anymore, at least). Have you checked your windows and screens? (As well as sunscreens for us in the west) How is the garage door? How is the microwave, printer, computer, washer and dryer, fridge? Even building supplies are feeling the pinch. Have you put off some home maintenance? Prices are going up; you may wait weeks or months for something that used to be on the shelves. So, get your house in order too – for peace of mind.
As for the world, everyone looks at us… the USA. Our economy is actually doing ok. Folks are getting back to work. Services are slowly returning to normal. Restaurants are full. New car lots are still empty… but mechanics are super busy keeping our older cars in top shape. Supplies for most auto parts are flowing, albeit slowly. Tires, wiper blades, and batteries are available, but the costs are WAY up.
Change is still our only constant.
Stay optimistic. I'm optimistic. I have a new Lil’ Schaeffer to watch grow up. That adds to my optimism! My family is healthy. I'm down 10 pounds from this time last year. Life is good!

This year is no exception. Here is a particular case that might apply to many folks reading the column this month. Charlene has been a client for years and annually submitted her request for research for us to perform her review. Her elderly father moved in with her recently, so Charlene became his “caretaker” and needed our help with his Medicare too. He is a WWII vet and always uses the VA. He never had the need or desire to go elsewhere. His doctor went on vacation and hadn’t come back for over three weeks, but he needed to be seen. Charlene didn’t know what to do. Obviously, she wanted to help him and just have him go see her doctor. The best remedy? She needed to get Dad a Medicare plan that would allow him to go outside of the VA for times like this…so she called us. Dad had not served long enough to be eligible for Tri-Care for life. Dad did have Original Medicare A and B but had never picked up a drug plan because he filled everything at the VA, and wanted to keep it that way. We needed to find a Medicare Advantage plan without a Part D drug plan built in. Luckily there are half a dozen Medicare Advantage plans without a drug plan in their county to pick from. Now, to search for plans that had Charlene’s doctor in-network so Dad could go too. 15 minutes later, together we found a plan that not only covered their doctor and hospital of choice, but also provided a $50 give back to his Part B premium every month!!! Charlene and Dad were ecstatic. This month’s article is to share a strategic opportunity. Congress is going after the largest IRAs. The proposals in Congress might not become law, but our clients are hearing about them and want to hear from us on planning moves they could make to be better prepared. Congress has set its sights on mega-IRA balances, in large part due to the recent reports about a five billion dollar Roth IRA. But some of these proposals will impact many other clients with smaller individual retirement accounts and Roth IRAs. Now for the provisions that can affect many more of our clients. The proposals include an all-out ban on back-door Roth IRAs and mega-back-door Roth IRAs (from company plans), regardless of income level, so this means everyone. If you have been taking advantage of these provisions, especially the lucrative mega-back-door Roth, which can allow up to $58,000 this year to be contributed to after-tax plan accounts and converted to Roth IRAs, generally tax-free, this may be your last chance. So, make sure you get these done before year-end. The proposed ban would be effective after this year, like the other provisions mentioned above. If you placed funds in a traditional IRA to get the tax deduction and tax differed growth. The consensus is that, regardless of what we are hearing from DC, taxes will likely go up. Yes, even for the middle class. The Fed is spending unprecedented trillions, borrowing money from other countries and printing more. Add to that, closing loopholes like Roth conversions, it may be a good idea to move a portion of your Traditional IRAs to Roth IRAs while the tax brackets are relatively low and may not get back to where we are now for many years. Kidney disease has many risk factors and the most common are diabetes and high blood pressure. Alcoholism, heart disease, Hepatitis C and HIV can also cause kidney disease. However, doctors have found that limiting or avoiding certain foods may help decrease the waste accumulation and improve kidney functions.
According to the National Kidney Foundation most recent guidelines we should limit sodium to under 2,300 mg per day.
Here are some foods to avoid or limit:Whole wheat bread has a high fiber content, so white bread is recommended.
Avocados, dates, raisins, and prunes have too much potassium
Brown rice managed portions only to control potassium & phosphorus.
Dairy is high in phosphorus and potassium. It may be important to limit dairy intake to avoid buildup of protein waste in the blood.
Oranges and orange juice. Again, high potassium content. Substitute grapes, apples, or cranberries.
Baked potatoes are high in potassium. Use sweet potatoes & soak in water to lower potassium levels.
Pretzels, chips, and crackers.
Talk to your doctor or work with a healthcare professional and renal dietitian to help you design a renal diet specific to your likes and needs.

What, or why, was the reason they were your Hero? Was it a friend, relative, neighbor? Because whatever the situation or whoever the person was, it made you….you.
As we meet with clients, we often hear their life stories as they share personal issues or events.
We often hear of an outstanding teacher or coach. Other times it was a particular boss at their job that made a positive impact on their life. But the main point is a person in your life might have put you on the path that made you what you are today. And it’s not always a family or friend that provides a meaningful impact.
I recently had the privilege of meeting not one but three 90-year-old Veterans. They were kind enough to engage me in their experiences from WWII. It was like opening a history book. One of them had landed in England, was part of the invasion on D-Day, and fought in the European theater for the rest of the war. When I thanked him for his service and told him he was my Hero of the day, he simply stated, "No, David, all the heroes are still over there." He was 18 when he shipped out and survived the war without a scratch. So veterans are absolute heroes to me.
Find and thank the folks who are your heroes because they are the ones who made you...you!

Especially since they have been playing since Halloween. Many people, like my family, never tire of the holiday songs and the warm fuzzy feeling they bring.
Approaching this time of year, we can choose to be a Santa or a Grinch. But you won't find any Bah Humbuggers in my sphere of friends or business associates because… you attract what you project!
Does rainfall in all our lives occasionally? You bet! Does it rain every day? Nope!
I find that by following a few simple rules, I enjoy life a bit more. What are those rules? I'm glad you asked!
-Avoid the news! We are bombarded with negativity in the media. Avoid news for one week and see how your attitude improves!
-Celebrate your successes! Even small ones. Pat yourself on the back because sometimes you are your best friend. And let's face it. Not everyone knows your struggles, so when you score a win…celebrate it!
-Find the good in others. This one is hard for me, especially driving to and from work every day and getting cut off in traffic. My first instinct is to think negatively about the bad driver, but what if they are responding to an emergency, I don’t know about?
The point is, only you can decide to be a Santa or a Grinch during these holidays. Choose wisely!

We started 2021 with high hopes of a new "normal." The pandemic coming to an end… life and business back to resembling what we used to know.
But honestly, I am not sure I can remember what 2019 felt like. I am not even sure where 2020 went or, for that matter, 2021!
Our team has endured a lot, and it is all thanks to YOU, our wonderful clients, that fuel our sense of purpose. To wake up every morning knowing that someone needs our help regardless of the climate outside… politically or literally.
Thank you to the thousands of folks that attended a 123Easy workshop - online or for a rare in-person library event (not all the cities have opened their doors to events). Whether we guided on the basics of Medicare, Social Security, or Retirement Income Planning… we appreciate every attendee.

For example, last month's newsletter reminded them about Medicare's Annual Election Period (AEP) that happens each year.
Jackie was perusing the latest edition and calmly asked Stan if he had replied to the emails, we send out to each client this time of year to get updated prescription lists. In addition, we do research based on your answers to ensure each client is on the most appropriate drug plan for the coming year because plans change every year even if YOUR needs don't.
"Humm," Stan replied absent-mindedly. "I don't remember. What does it matter anyway since we both only take a few generic medications? I'm sure we are fine for next year."Jackie responded, "I remember when we met with David, he said it was important to check our plan every year. So I'd feel better if we sent our lists and completed the reply. I'll grab our medications to help." Stan completed his response and then Jackie sent hers and awaited a recommendation in the days to follow.
The couple was pleasantly surprised by the research response they received. "Holy Crap!" He exclaimed. "David's research team just answered our email. We need to schedule an appointment ASAP as the premium for the Part D Prescription Drug plan we are on is going to increase from $14 a month to $56a month." "HOW MUCH!?!?" Jackie could not believe her ears.
They made phone appointments to review their options for 2022 Part D drug plan changes and were again surprised to learn that just by shopping plans, they were going to save close to $1,000 next year.

They are a concentrated source of protein and very rich in fiber and look very much like black pepper granules. Chia seeds help keep the body feeling full and energized for hours. So, how do you use them? You can sprinkle them into salads, cereal, oatmeal, soups, puddings, etc. They are tasteless, or mild and nutty, but when added to a liquid, Chia seeds expand somewhat into a gel. I personally have started adding them to all types of foods.
Here are some of the benefits:
- May stimulate weight loss, mainly because they are high in fiber and make the stomach expand and feel fuller. The high protein content also helps control appetites.
- Promotes healthy digestion. Eleven of the 12 grams of carbs are fiber and fiber does not raise blood sugar or require insulin.

[et_pb_section fb_built="1" _builder_version="3.22"][et_pb_row _builder_version="3.25" background_size="initial" background_position="top_left" background_repeat="repeat"][et_pb_column type="4_4" _builder_version="3.25" custom_padding="|||" custom_padding__hover="|||"][et_pb_text _builder_version="4.4.4" hover_enabled="0"]This month, I address an issue that is most likely going to get worse next year. I'm talking about Capital Gains Tax. House Democrats proposed a top federal rate of 25% on long-term capital gains by the House Ways and Means Committee. The maximum rate would be 28.8% when combined with a 3.8% surtax on net investment income. In 2022, it would kick in for single filers with taxable income over $400,000 and for married couples at $450,000, according to a committee aide. Now, I understand that this will affect a relatively small number of our clients. But, that said, it will affect some of you a lot.
This article is aimed at helping those of you that have highly appreciated assets and would like to sell said asset but feel that the capital gains tax would be prohibitive and eat up your gains. However, there is a possible solution.
The solution: A Charitable Remainder Trust (CRT) or Unitrust (also called a CRUT) is a gift of cash or other property to an irrevocable trust. The donor receives an income stream from the trust for a term of years or for life, and the named charity receives the remaining trust assets at the end of the trust term. But wait, that's not all. It's got a bit complex, but I will simplify as best I can.
Let's assume the asset is a building. You bought this building several years ago for 1 million. It's now worth 5 million. You create a CRUT and gift your building to that CRUT. You get a monster tax credit that you can use for 1 plus an additional 5 years, depending on when you need it. The CRUT then sells the building. Guess who is exempt from capital gains tax? Yup, the Charitable Trust! You then get to take income from the trust for the rest of your and your spouses' life.
When you die, the charities you named in the CRUT will receive the "remainder" of the assets in the trust. You can even create your own trust foundation and make your kids the trustees. They would then oversee dolling out the remainder to the charities of their choice. This can go on for decades after you pass. And the kids can take a fee for being the trustees.
Let's talk about the kids. You scored -the IRS lost (using their own rules)but the kids also may have lost. So, to make the kids whole, you can take a fraction of the income from the trust over the first 7 years and buy a Last to Die Life Insurance Policy to replace the 5 million. We would create another trust called an Irrevocable Life Ins Trust to buy the life policy. We do that to keep the death benefit and cash value outside of your estate for estate tax purposes because, let's face it, that probably will get worse too.
So, if this scenario fits you and your stock, real estate, precious metals, or any other highly appreciated asset, we are here to help. This is not something that most advisors out there know about or are experts at doing. We have worked with outside counsel uniquely versed in these strategies, and I have had experience creating these arrangements over the years.
